Terms of Service

These Terms of Service (the "Terms") govern your use of the TackleIt desktop applications, including TackleIt PDF (the "Software"), and the website at tackleit.app (the "Site"). By downloading, installing or using the Software, you agree to these Terms. If you do not agree, do not use the Software.

1. Who we are

The Software and Site are provided by [LEGAL ENTITY], a sole proprietorship registered in Poland, with its place of business at [ADDRESS], tax ID (NIP) [NIP] ("we", "us", "our"). You can contact us at hello@tackleit.app.

2. License grant

Subject to these Terms and payment of any applicable fee, we grant you a perpetual, worldwide, non-exclusive, non-transferable license to install and use the Software for your personal or internal business purposes. The Software is licensed, not sold; we retain all intellectual property rights in it.

The Software is offered in tiers - Free, Pro and Pro+ - each unlocking the features described on the product page. A paid license unlocks the corresponding features on your device.

3. Restrictions

You agree not to: (a) resell, rent, sublicense or redistribute the Software or license keys; (b) share a license key beyond the seats you purchased; (c) reverse engineer, decompile or disassemble the Software except to the extent this restriction is prohibited by applicable law; or (d) remove or alter any proprietary notices.

4. Payments, invoices and Merchant of Record

Orders and payments for paid licenses are processed by our authorised reseller and Merchant of Record, Paddle.com Market Ltd ("Paddle"). When you buy a license, your contract of sale for that transaction is with Paddle, and Paddle's Buyer Terms also apply. Paddle handles billing, payment processing, tax/VAT collection and invoicing. VAT invoices, including B2B invoices with your company details and NIP, are available through Paddle at checkout.

Prices are shown at checkout and may include applicable taxes depending on your location.

5. Refunds and right of withdrawal

Refunds are handled by Paddle in accordance with their Buyer Terms. We offer a 14-day money-back guarantee on paid licenses; to request a refund, contact hello@tackleit.app or Paddle directly.

If you are a consumer in the European Union, you normally have a 14-day right of withdrawal for digital content. By starting your download or activating the license within that period, you request immediate performance and acknowledge that you lose the right of withdrawal once performance has begun, to the extent permitted by law.

6. Updates

We may release updates and bug fixes for the Software from time to time. We are not obliged to provide updates, new features or support for any particular period unless stated otherwise at purchase.

7. Disclaimer of warranties

The Software is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the maximum extent permitted by law. You are responsible for keeping backups of your files. Nothing in these Terms limits statutory rights that cannot be excluded, including mandatory consumer rights.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, or for loss of data or profits arising from your use of the Software. Our total liability for any claim relating to the Software is limited to the amount you paid for the license in the 12 months before the claim. This does not exclude liability that cannot be excluded under applicable law.

9. Governing law

These Terms are governed by the laws of Poland. If you are a consumer, you also benefit from any mandatory protections of the law of your country of residence, and nothing here deprives you of those rights. Disputes are subject to the competent courts of Poland, unless mandatory law provides otherwise.

10. Changes to these Terms

We may update these Terms from time to time. The current version is always posted on this page with the "Last updated" date. Material changes will not apply retroactively to a license you already purchased.
